1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, software, and related services (collectively, the "Service") provided by Mobile Vision Technologies LTD ("we", "us", "our", or "Company"), a company registered in England and Wales.

By accessing, downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction to consent to the processing of your personal data, to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian.

4. Accounts and Registration

Certain features of the Service may require you to create an account. When you create an account, you agree to:

  • Maintain and promptly update your information to keep it accurate and complete
  • Keep your login credentials confidential and not share them with any third party
  • Notify us immediately of any unauthorised use of your account or any other breach of security
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, outdated, or incomplete.

5. Acceptable Use

You agree not to, and not to permit any third party to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation
  • Copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the Service, except to the extent such restriction is prohibited by law
  • Circumvent, disable, or otherwise interfere with security-related features of the Service
  • Use any automated system, including robots, spiders, or scrapers, to access the Service in a manner that sends more requests than a human could reasonably produce
  • Introduce viruses, malware, or any other malicious or technologically harmful material
  • Attempt to gain unauthorised access to the Service, other user accounts, or any connected systems or networks
  • Resell, sublicense, rent, lease, or otherwise commercially exploit the Service without our prior written consent
  • Upload or transmit content that is unlawful, defamatory, infringing, obscene, or otherwise objectionable
  • Use the Service in any way that could damage, disable, overburden, or impair it

6. Intellectual Property Rights

The Service and all of its original content, features, functionality, source code, designs, text, graphics, logos, and trademarks are and will remain the exclusive property of Mobile Vision Technologies LTD and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. User Content

You retain all ownership rights in any content you submit, upload, or otherwise make available through the Service ("User Content").

By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free licence to use, host, store, reproduce, modify, and display that User Content solely for the purpose of operating, providing, and improving the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party. We may remove any User Content that we reasonably believe violates these Terms.

8. Purchases, Subscriptions, and Payment

Some parts of the Service may be offered for a fee, on a one-off or recurring subscription basis. Where you purchase a paid feature:

  • All prices are stated inclusive or exclusive of applicable taxes as indicated at the point of purchase
  • Purchases made through a third-party app store or payment processor are additionally subject to that provider's own terms
  • Subscriptions renew automatically for the same period unless cancelled before the end of the current billing cycle
  • You may manage or cancel a subscription through your account settings or the relevant app store
  • We may change our pricing at any time; changes to recurring fees take effect at the start of the next billing cycle following reasonable notice

9. Refunds and Cancellation

Where a purchase is made through a third-party app store, refunds are handled by that store in accordance with its own refund policy.

If you are a consumer in the United Kingdom or the European Economic Area, you may have a statutory right to cancel a purchase of digital content within 14 days. By downloading or accessing digital content immediately, you acknowledge that you may lose this right of withdrawal once supply of the content has begun. Nothing in these Terms affects your statutory rights.

10. Third-Party Services and Advertising

The Service may contain links to, or be integrated with, third-party websites, services, software development kits, analytics providers, and advertising networks that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. Your use of those services is governed by their own terms and policies.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to the processing of your data as described in that policy.

12. Availability and Changes to the Service

We aim to keep the Service available at all times, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our reasonable control.

We reserve the right to modify, suspend, or discontinue the Service, or any part of it, at any time with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

13. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will meet your requirements, be uninterrupted, secure, or error-free, or that any defects will be corrected. Nothing in these Terms excludes or limits any warranty or condition that cannot lawfully be excluded or limited.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Mobile Vision Technologies LTD, its directors, employees, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or in connection with your use of, or inability to use, the Service.

Our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid us for the Service in the twelve months preceding the event giving rise to the liability, or (b) GBP 100.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Mobile Vision Technologies LTD and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your breach of these Terms.

16. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may stop using the Service at any time and, where applicable, delete your account. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination, including ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution, shall survive.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.

The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer resident in another jurisdiction, you retain the benefit of any mandatory protections and the right to bring proceedings in the courts of your place of residence.

18. Changes to These Terms

We may revise these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date at the top.

Your continued use of the Service after the revised Terms take effect constitutes your acceptance of the changes. You are advised to review these Terms periodically.

19. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
  • Third-Party Rights: A person who is not a party to these Terms has no right to enforce any of its provisions.
